Orders / contract conclusion
The general terms and conditions form the basis for a fair relationship between the customer and Cafiosa AG (hereinafter referred to as Cafiosa). When sending an order, the customer agrees with general terms and conditions. If the ordered goods are not available in the desired amount or at the price specified on the homepage, this will inform the customer as quickly as possible. We do everything we can to serve our customers to their fullest satisfaction.
validity
Our entire offer from http://www.cafiosa.ch is aimed at our customers within Switzerland and the Principality of Lichtenstein. Deliveries abroad require the previous agreement.
Data protection
Personal customer data are treated confidentially in accordance with data protection legislation and are neither passed on to third parties nor sold. Sensitive data, in particular information on payments with a credit card, are encrypted for the authorization query. Only data is recorded that are required to process the order and the recurring customers simplify the operation of the online shop.
Delivery conditions
- Deliveries are sent by post and are over an order value of CHF 90.00 all over Switzerland.
- For orders under CHF 90.00, we offset a postage of CHF 11.00 (excl. Samnaun). The goods are delivered quickly.
- For goods exports abroad, additional costs, such as shipping or customs costs, may apply. These are to be fully worn by the customer.
Prices and payments
All prices are per article in Swiss francs and excluding VAT. Price changes and time -limited actions are possible at any time and do not require any announcement. The prices given in the online shop apply at the time the contract is concluded. The goods remain the property of Cafiosa AG until full payment. All credit card payments are processed using the common Payment platforms.
Price changes are expressly reserved.
Local notification
The customer is obliged to check the delivered goods immediately after receipt of the delivery and to report any defects immediately by letter or email. After 5 days after receipt of the delivery, the delivery is considered approved.
Returns to Cafiosa AG take place at the account and risk of the customer. The customer has to send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to Cafiosa AG, Seestrasse 9 in 8330 Pfäffikon.
If the examination by Cafiosa AG arises that the goods have no noticeable defects or that they do not fall under the manufacturer's guarantee, Cafiosa AG can invoice the customer to the customer. The same applies to damage as a result of improper storage.
Liability
Cafiosa AG assumes no liability in the event of incompatibility or late delivery of products by incorrectly declared delivery addresses, absence of the recipient, customs problems (export) or events that are due to force majeure.
It also assumes no liability for damage or viruses caused by accessing your website. Each customer is responsible for the confidential treatment of their password for online orders. A transfer to third parties is prohibited. Cafiosa cannot accept any liability for any abuse of the password by third parties.
Legal notice
Subsidiary agreements or changes to these terms and conditions require their validity of the written form.
If individual provisions or parts of provisions of these terms and conditions are ineffective, this does not affect the effectiveness of the terms and conditions. In this case, the parties strive to find a replacement agreement that comes closest to the original intentions of the parties.
Disputes from or in connection with these terms and conditions are subject to only material Swiss law to the exclusion of the UN sales law and collision law. The District Court of Pfäffikon ZH is the only place of jurisdiction for all of the contractual relationship between Cafiosa AG and the customer, which arises directly or indirectly.
